The domestic violence charges against Nikki Garcia’s estranged husband, Artem Chigvintsev, have been dropped following a “thorough” investigation.
The Napa County District Attorney’s Office announced Tuesday that the “Dancing With The Stars” pro will not be charged after “careful evaluation of the evidence presented” following an alleged incident on Aug. 29.
“While we take every arrest seriously and stand firmly against domestic violence, we have an ethical obligation to only file charges when supported by the evidence,” DA Allison Haley said in a press release.
“We are required to prove any and every criminal charge ‘beyond a reasonable doubt’ which is the highest standard in the American criminal justice system.”
She continued, “If the available evidence doesn’t rise to this level of proof, then we cannot ethically file charges.”
Reps for Garcia and Chigvintsev weren’t immediately available for comment.
This latest development comes almost a month after officers arrested Chigvintsev at the Napa Valley, Calif., home he shared with Garcia, 40, for allegedly attacking her.
At the time, police witnessed injuries on the victim, who requested “total confidentiality,” which led to the 42-year-old’s arrest.
Although the victim’s identity wasn’t released, the 911 call confirmed the former WWE star was in the home at the time of the incident, along with a child assumed to be their 4-year-old son, Matteo.
The “Dancing With the Stars” pro posted bail for $25,000 that same day.
According to TMZ, Garcia — professionally known as Nikki Bella — started to look for a divorce lawyer one day later.
On Sept. 11, she pulled the plug on her marriage to Chigvintsev and requested full custody of their son.
The estranged couple met in 2019 on Season 28 of “DWTS” and wed three years later.
Days before the Russian dancer’s arrest, they celebrated their wedding anniversary.
